Title
自動車の完全自動運転下における損害賠償ルールと安全性能の選択
Abstract
完全自動運転自動車が社会に普及した場合、事故確率や被害額は自動車性能のみによって決まるため、事故責任は自動車性能のみに帰する。このため、 被害額の負担について、損害賠償制度による解決に加え、製造物責任による 解決が可能となる。事故被害の負担ルールは、自動車製造業者や自動車利用 者の安全性能の選択や利用者の自動車利用頻度に影響を与える。Shavell (2020)は、自動車利用者の意思決定に焦点を当て、ファーストベストを実 現するためには、事故当事者が自分の被害額を自己負担するとともに、相手 の被害額を政府に支払う損害賠償制度(Shavell ルールと呼ぶ)が必要なことを示している。本論文で、Shavell (2020)を安全性能の技術開発を考慮したモデルに拡張すると、ファーストベスト実現のためには、(1) 個人の効用 関数が同一の場合、Shavell ルールでは、過大な安全性能技術が開発される ため、安全性能に応じた自動車購入税、あるいは、技術開発税の導入が必要、 (2)このとき、自動車利用に応じたフェアプレミアムな損害保険が利用可 能な場合には、(1)と同等の政策が必要、(3)効用関数に異質性があると、 技術開発のインセンティブを強める必要が生じる場合があり、その場合、自動車購入補助金、あるいは、技術開発補助金への変更が必要、(4)製造物責任制度の下では、自動車利用税及び自動車購入補助金の実施が必要となることを示す。
